Abstract

The purpose of the doctoral thesis is based on the analysis of the new legislation concerning the application of Spanish jurisdiction in cases of drug trafficking in which the vessel or vessel has been intercepted in international waters, due to the change suffered in March 2014 of art. 23 of the Organic Law of the Judicial Branch in relation to the criminal type of drug trafficking. This thesis analyzes the national norm in relation to the international conventions, as well as the different judicial pronouncements in the matter, to determine that the restriction to the application of the principle of universal justice carried out by the national legislator has to be revised And applied in compliance with the international commitments to which Spain has committed itself in the field of drug trafficking
