This research seeks to provide a contribution to the Spanish procedural law, from an academic perspective. Which can provide new ideas and deepening awareness of the existence of Latin American indigenous peoples, whose rights and ways of administering justice are recognized nationally and internationally. The aim then demonstrate that this is a hot topic and with full force, even within a European country with no indigenous population such as Spain
