Abstract

The thesis comprises three chapters, in which the first is devoted to the study of circumstantial evidence under the general theory of evidential activity, the second, meanwhile, is aimed at identifying specific elements that allow us to state the compatibility of circumstantial evidence and the right to presumption of innocence in criminal proceedings, and, finally, the third involves the analysis of specific pathways that allow the control of circumstantial evidence, as an effective mechanism to ensure the protection of referred fundamental right.
