Abstract

The fundamental rights have an important place in the hierarchy of legal norms. The main task of the state focuses on achieving the effective exercise of those rights, hence the issue of security has been relegated to the background the conceptual problem. Among the guarantees those of a judicial nature have a prominent place, but there are also in the constitutions, a set of guarantees by which different institutions are entitled to carry out the rights and freedoms of citizens. Among the specific institutional guarantees deserves special reference the Ombudsman. In the following pages we will proceed to make a legal analysis, in comparative perspective, the Spanish Ombudsman (Spanish Constitution of 1978) and the Colombian Ombudsman (Constitution 1991).
