Resumo
The purpose of this work is aimed at a careful study of certain contentious aspects of the legal regime of extrajudicial establishing parentage in force today. To do this, the last changes occurred in the field, highlighting omissions and contradictions between some of these recent reforms and the basic principles of legal regime being reviewed. In fact, its main purpose lies in pointing out the need to discuss a profound transformation of the current system of determining parentage, to include a new class of filiation, based on the volitional element, which enable to meet new needs and realities that for law has meant filiation derived from assisted reproduction techniques and regulation of same-sex marriage.
