Abstract

This aim of this study is to examine the principle of equal treatment and non discrimination on the grounds of age, disability and sexual orientation as regards access to employment and working conditions in the European Union. The starting point is the analysis is the Directive 2000/78/CE, establishing a general framework for combating discrimination in employment and occupation. The study focuses next in the European Union Court of Justice case law applying the Directive in the context of the questions referred for a preliminary ruling by national judges and Courts. The most relevant issues treated by the Court deal with compulsory retirement in relation to age, the concept of discrimination by association in relation to the disability and the entitlement to surviving complementary pensions in relation to sexual orientation.
