Zusammenfassung
The constitutional guaranties of the evidence collection process become obsolete when the main procedural subjects can not directly access the practice of certain modes of evidence collection. In this paper we attempt to evaluate to what extent hearsay evidence can be admitted in a due criminal process, and if so, with what obligatory requirements considering the jurisprudence elaborations of Spanish law. After examining the concept of hearsay evidence in the Spanish Criminal Process Code and its necessary limitations, we analyze the problems that arise regarding the indirect introduction of certain declarations of informants, suspects, or victims in a process.
