Zusammenfassung

The European Union Court of Justice has pronounced for the second time the interpretation of Article 6 (2) of the Rome Convention (the current Article 8 of the «Rome I» Regulation). And, for the second time, the applicant is an international transport worker, but unlike the Koelzsch case when the applicant was a truck driver, this time he is a sailor on board of a merchant ship. This case concerns the interpretation of the concept �country of the place of business through which the employee was engaged� where the employee does not habitually carry out his work in the same country, within the meaning of Article 6 of the Rome Convention. Nevertheless, the Court of Justice confirms that the rule �the employer�s place of business� is applicable only in the alternative, considering that it is possible to identify a �habitual place of work�.
