Abstract

The position of credit managers in insolvency proceeding is treated by the Spanish legislature harshly on the idea that the existing information asymmetry in the birth of the credit status of foreign creditor must be compensated subordination. A subordination that operates automatically without taking into account the time of birth the same, to a model in which this criterion is replaced by the broader reference of two years preceding the declaration of insolvency have chosen.
