Abstract

The ADR ways of composing conflicts have acquired an undeniable role in the recent decades. At the EU level, in general, and, likewise, in the spanish case. The negotiation between the parties or the recourse to a third party they constitute, schematically presented, both possibilities for the settlement of the conflict, within which, in turn, there are several figures that present many nuances.This essay approaches a definition of mediation, as well as its characteristics and typology, to conclude with an exhibition of the mediator position, his skills and the elements that influence the success or failure of the procedure.
