Abstract
On the basis of the recent judgment of the ECJ of 11 September 2019, the main objective of this work is to determine in which cases workers defined as particularly sensitive to certain occupational risks (for the purposes of art. 25.1 of the LPRL) may be considered as disabled workers for the purposes of Directive 2000/78/EC of 27 November 2000 on the establishment of a general framework for equal treatment in employment and occupation, and then to analyse what the legal consequences of such equal treatment would be.
