Abstract

In the following pages, we will proceed to a qualitative analysis of the standard in question. From a gender perspective, applying the principles of equality and non-discrimination, with its full force in the present time, we can question the regulation of underground work for women. The absolute prohibition operates as a presumption of full right of female ineptitude for the development of mining work. This led to an unprecedented political and regulatory conflict in Spain that led to the denunciation of Convention No. 45 by the national authorities. The Constitutional Court of Spain closed the door to the Convention ruling to distort the validity of equality as a value, principle and right, as provided for by the constitutional framework of reference. With the same premises that the Maximum Interpreter of the Constitution had already done more than a decade ago, we are going to translate the reasons that remain on the table so that equal treatment and opportunities can be established in all working relationships worldwide
