Abstract

InsurTech is known as a great ally for the insurance sector in order to mitigate its market failures –especially, the information asymmetry– allowing the configuration of a much more efficient market. Information is a key and the information flows between competing entities through contractual networks is more than a consolidated practice; a practice that, for its part, has been accepted by competition authorities given its enormous pro-competitive effects. However, the emergence of the InsurTech phenomenon can generate hitherto non-existent antitrust problems and alter the result of the evaluation of these networks, traditionally considered as exempt conducts.
