Abstract

The report to be drawn up by the Bankruptcy Administration in the qualification phase of the competition in accordance with article 448 of Royal Legislative Decree 1/2020 of 5 May, approving the consolidated text of the Bankruptcy Act, is a basic piece for the completion of the bankruptcy procedure. We have before us an essential document for the Judge of the contest, since it must be based on him to dictate the Judgment that qualifies the contest as guilty or as fortuitous. However, in spite of its importance, today there are still important issues to be resolved with regard to this document, such as the questionable time frame for its preparation or its controversial legal nature, issues that will be response in this study.
