Abstract

This article explores in an exploratory way the criminal responsibility of legal persons in Spanish lawand in the draft new Brazilian Criminal Code. The methodological approach used is based on the the-oretical-critical analysis of the models of criminal responsibility of the juridical person mentioned,seeking to understand the particularities of each microsystem, also observing the political-criminaland criminological presuppositions, to understand the fundamental importance that these disciplinesPossess for the understanding of subject with such great complexity. Finally, it is concluded that thecriminal responsibility of the Legal Persons represents an emerging demand for criminal policy in thefight against crime in this area, however, in the analyzed models, there are inconsistencies that mustbe solved by criminal-legal science.
