Abstract
This article analyses the effect that a collective injunction may have towards the posterior injunction that the individual consumer brings in order to determine if there is the lis pendence pretended by the banking entities or if that preclusion may affect the access to justice of the consumer – as the European Court of Justice understands. The solution to this problem requires a deep study of the underlying interests to the action brought, placing the accent on their titularity, as it is the key to determine if there is the identity of subject that lis pendence requires.
