Resumo

As recently the European Commission has described algorithmic management of workers as a serious concern for the efectivity of the UE Social Law that supports the European Social Model, this paper makes a panoramical analysis about actual and future Law on the use of algorithms in the work context. Beginning with a previous study focusing on the actual European legal frame about algorithmic responsability (GDPR), as well as on the open and multilevel process of governance of IA, two important and connected European Regulation iniciatives are critically examined: the Proposal of a Regulation for IA in Europe (April 22nd 2021), and the Proposal for improving the working conditions of people working through digital labour platforms (December 9th 2021). Finally, a short approach to algorithmic management in actual Labor and Social Security Administration sanctioning procedures is also made.
