Resumo
The situation of exceptionality in which our bankruptcy law is submerged at the mercy of the moratorium approved by the Government in March 2020 and which keeps suspended the duty to request the assistance for those debtors who are in a situation of insolvency or close to insolvency, has generated a false appearance of immunity that will only end once the current legal blockade is lifted. It will be at that time, with the opening of the corresponding qualification sections of those bankruptcy proceedings that are declared, when the position of the Courts of Justice is known with regard to the action taken by debtors in the 21 months that the moratorium will last.
