Abstract

This work has sought to re-address the issue of parental responsibility for harmful acts of children, with the principle of parental co-responsibility fully established in our legal system and in our society. If there is no doubt about the joint exercise of parental authority during marriage, when the parents do not live together it is no longer so evident. With the approaches of the obvious doctrinal discussions on the merits, we will see how the responsibility of the parents has been objectivized for reasons of guarantee and compensation, to compensate the victim of the damage in the best possible way. Finally, we briefly analyze the advantages of the joint exercise of parental responsibilities and we will refer to the reform of Law 8/2021, of June 2, on the subject at hand.
