Abstract

Law 16/2022, of September 5, reforming the revised text of the Bankruptcy Law, approved by Royal Legislative Decree 1/2020, of May 5, has brought about a substantial change in our insolvency regulations. Among its many novelties, the creation of a special procedure for micro-enterprises stands out, which allows a much more agile and simple procedure than the ordinary bankruptcy process to settle the economic crisis situations of these micro-operators, which constitute, without a doubt, the type predominant entrepreneur in our country. Within this special procedure, the analysis of the abbreviated qualification is of interest, which presents a series of peculiarities, as well as some questions for its application. Our job is to give greater clarity to the subject so that the reader is pleasantly instructed about it.
