Abstract
This study defends the nullity of any «resolutive condition» of the employment contract for poor performance. Nullity due to illegality, for violation of the mandatory labor regime of employees» breaches, which does not admit the intervention of contractual autonomy to the detriment of the employees. This thesis, supported by comparative law, aims to put an end to the case law and the majority of scientific doctrine, in favor of the initial lawfulness, without prejudice to the possible abuse of rights by the employer in some cases of «resolutive condition» of the employment contract due to poor performance.
