Abstract
The temporary or indefinite nature of the compensatory pension continues to be one of the most controversial issues in its legal regime and with the greatest practical implication. Choosing between one modality and the other requires a prospective assessment on overcoming the economic imbalance. In recent years, the Supreme Court has been outlining the requirements of this prospective assessment and the criteria for establishing temporary pensions. The objective of this work is to review and analyze this jurisprudential doctrine with special attention to the latest sentences on the matter
