Abstract

This jurisprudential comment addresses the case Godenau vs. Germany and reflects on the duty of loyalty to the Constitution of teachers in the German country. A teacher is fired and, later, included in a list of teachers unfit to work as teachers in regional public schools due to her involvement and active militancy in extreme right-wing political formations, understanding that this professional duty that starts from the Constitution of the Federal Republic of Germany has been breached. The European Court of Human Rights endorses the measure of the Land of Hesse, based on certain actions of Ms. Godenau
