Zusammenfassung
We approach Human Rights in relation to access to justice, bringing the Mediation as a new option for the citizen. Alternative forms of conflict are increasingly present in our everyday life, mediation has come to stay, and data are increasingly present, the importance of the theme as a means of social pacification is verified. With the Judiciary more and more delayed Mediation appears with a faster solution, but this does not mean that it is some kind of substitution from the traditional to the procedural method, but an option. Among the main benefits of mediation, we mention the reduction of emotional exhaustion, besides the reduction of costs, bringing the figure of the mediator as a fundamental piece for all this delineation. We conclude comparing Mediation in Brazil and Portugal, what measures are necessary for its application, its problems, and solutions.
