Abstract
This article aims to illuminate possible answers to the reasons why European migratory policy exists and its legitimacy, especially focused on migratory flows by sea and land from Africa to Spain. The commitment of the European Union and the Spanish State to control their borders at the cost of not respecting the human rights that govern their social and legal identity, places them at an uncomfortable crossroads. However, these selective and excluding practices try to be legitimized –among other things– by science. It is proposed to question the bases of the common logic that crosses certain currents of thought of traditional criminology to analyze the impact of their proposals on public policies -especially criminal- using the European migration policy as an example.
