Resum
In the area of civil liability in health matters, the debate regarding damages payable due to lack of informed consent or the provision of defective information to the patient remains ongoing, especially when the medical intervention is conducted in accordance to lex artis. The article defends the compatibility between compensation for autonomous damage derived from the mere lack or defect of informed consent and compensation for death or injuries objectively attributable to alleged assumption of risk, with other lines of argument discussed and rejected.
