Zusammenfassung

Hate crimes are one of the expressions of greatest social harm in relation to the condition of people from a double perspective of threat of harm to the passive subjects of the crime and rupture of social peace and acceptance of concurrent differences. in the people who make it up. Procedurally, the analysis of the circumstances that occur in the investigation and prosecution of hate crimes presents numerous challenges. Some of these challenges are analysed in this work, assessing the singularities both at the level of the principles of the process, and with respect to the victim’s statement, from their consideration of especially vulnerable victims or, ultimately, the importance of the circumstantial evidence. using the so-called “polarization indicators”.
