La guarda y custodia de los menores. Últimos criterios jurisprudenciales (2022-2023)

Abstract

This article analyses the latest court judgments on the care and custody of minors, in particular those handed down by the First Chamber of the Supreme Court in 2022 and 2023 as well as some recent decisions issued by Provincial Courts. Many of them refer to the different criteria for attributing custody, which have already been subject to a substantial body of case law. But other issues are also addressed, inter alia, those related to the amendment of the custody regime, the need for parenting plans, requests for shared custody, the effects of violence on custody and the effect of custody on the alimony due as well as on the use of the family home.
