Abstract
Multifunctional nature of shape creations imposes the existence of an array of cases of cumulation of protection. The recent CJEU decision on Cofemel case has subtracted an important facet of the interpretative building upon Industrial Design rests. The paper aims at establishing a new framework that attends to the communicative nature of design and art, in order to separate them. Then it tries to reapply it in other overlap scenarios.
