Abstract

The principle of procedural proportionality has developed in countries such as Canada, the United Kingdom, Australia, and New Zealand. However, it has not been the subject of research or regulation in Latin America. Its regulation, adaptation and application in Latin American systems will be very useful to strengthen Civil Justice. We analyze the idea of proportionality, the conceptual framework of the principle, its strengths and weaknesses and the applications, especially in Canada, generating inputs for the analysis of its application in Latin America.
