Abstract

The article analyses one of the transcendental issues that every country that aspires to follow the path of economic development must face, that is, the security, speed, and efficiency that the respective registry system grants to the real estate legal traffic. In fact, the current economic dynamism demands a free circulation of wealth in all areas as far as this research is concerned, that real estate transactions be expeditious and that the Real Estate Registry Law grants an adequate legal security to the agents involved in them. In this sense, the purpose of this research is to determine whether the Chilean registry system provides adequate legal certainty to the real estate traffic in its respective property registry and in the registry qualification. To meet this objective, some particularities present in our system are presented, considering the legal and regulatory norms currently in force regarding the real estate cadaster.
